New ‘Facilitation' Directive: migrant people and solidarity under threat

On 28 November 2023, the European Commission adopted a proposal for a Directive laying down minimum rules to prevent and counter the facilitation of unauthorised entry, transit and stay in the Union (known as the 'Facilitation' Directive), without any prior impact assessment. Intended to replace and expand the EU legal framework currently in force on this matter (the 2002 'Facilitators Package'), it updates the definition of the offence of facilitation and the existing criminal law framework.

The new Directive was presented by the European Commission as a means of 'improving' and 'modernising' the current legal framework. Yet, far from resolving the problems posed by this framework, it instead introduces new grounds for criminalisation, without including any exemption provision for humanitarian action or human rights defence work. Several organisations and institutions have warned of the risk of systematising the criminalisation already experienced today by migrant people and solidarity organisations. In the coming months, the text will be negotiated among the European institutions.

This analysis aims to shed light on the main changes this text would introduce, as well as the risks it poses for both people on the move and those who support them.

Le 28 novembre 2023, la Commission européenne a adopté une proposition de directive établissant des règles minimales pour prévenir et combattre l'aide à l'entrée, au transit et au séjour non autorisés dans l'Union (dite directive « facilitation »), sans étude d'impact en amont. Destinée à remplacer et à élargir le cadre juridique européen actuellement en vigueur à ce sujet (le « train de mesures anti-passeurs » de 2002), elle met à jour la définition de l'infraction de facilitation et le cadre pénal existant.

La nouvelle directive a été présentée par la Commission européenne comme un moyen d'« améliorer » et de « moderniser » le cadre juridique actuel. Mais, loin de résoudre les problèmes posés par ce cadre, elle introduit, au contraire, de nouveaux motifs de criminalisation, sans inclure de disposition d'exemption pour l'action humanitaire ou la défense de droits. سياسات التأشيرات: تمييز وظلم

ثلاثة وعشرون بالمائة من مطالب التأشيرة التي تقدم بها مواطنات ومواطنون من البلدان المغاربية بين 2021 ومارس 2022، قد تكون رُفضت، وذلك عقابا لمواقف الدول الثلاث المعترضة على استعادة مواطنيها الذين لا يحملون وثائق ثبوتية،
هكذا اذن وبدعوى محاربة الهجرة غير النظامية لا يجد وزير الداخلية والسلطات الفرنسية حرجا في المضي قدما في هذا الاجراء التمييزي الذي لا يعدو ان يكون عقابا جماعيا ظالما يستهدف كل الجزائريين والمغاربة والتونسيين، والحصيلة ان يقع رفض طلب التأشيرة لكل مواطن مغاربي يرغب في السفر بدافع السياحة أو الدراسة أو العمل أو لأسباب صحية او عائلية.
في الحقيقة، ان هذه الاجراء الذي ينتهك التواصل الانساني بين الشعوب يؤدي الى نتائج كارثية، اذ يدفع بآلاف الشباب والمراهقين، رجالا ونساء واطفالا، الى ركوب مخاطر البحر، معرضين أنفسهم الى خطر الموت،
لذلك، نؤكد ان هذا الابتزاز غير المقبول والمشين يمثل انتهاكا لحق ثابت من حقوق الانسان، وهو حرية تنقل الاشخاص، بما ذلك اولئك الذين لهم روابط عائلية واجتماعية، سواء في فرنسا او في بلدان المغرب الكبير، كما انه ابتزاز مرفوض، اخلاقيا لأنه يرتكز على قرار تمييزي وينتهك مبدأ المساواة بين المواطنين. والنتيجة هي ان الفرنسيات والفرنسيين من الدول المغاربية الذين يرغبون في إحضار والديهم لزيارتهم أو لأسباب خاصة أو صحية يجدون أنفسهم، أيضًا محرومين من حق أساسي.
ان الادعاء بمكافحة الهجرة غير النظامية عبر تقييد عدد التأشيرات بهذه الحدّة هو قرار سياسي خاطئ لن يحل شيئًا سوى استمالة الأطروحات الاكثر تطرفًا وكراهية للأجانب في فرنسا وكذلك استمالة أنصار "أوروبا المحصنة."
ويصبح الامر مخجلا حين نعلم -إذا ما اخذنا حالة تونس فقط -أن أكثر من 39000 مهندسا و3300 طبيبا قد غادروا البلاد منذ عام 2015، هؤلاء فتحت لهم اروبا ذراعيها.
وطبعا، يؤثر هذا التدفق الهائل للمهارات (التقنية والطبية وشبه الطبية) بشكل خطير على جميع قطاعات النشاط، ولا سيما قطاع الصحة العمومية، ويبرز أوجه القصور وعدم المساواة في أقل المناطق نموا في جميع البلدان المغاربية.

إن التقدم اليوم للحصول على تأشيرة عن طريق المصالح القنصلية الفرنسية والأوروبية (منطقة شنغن) في أحد البلدان المغاربية، هو كفاح حقيقي للمواطنين المغاربيين، حيث يواجهون في أغلب الأحيان مزيدا من الاذلال، اضافة إلى قسوة الانتظار لعدة أسابيع، أو حتى شهرين أو أكثر، للحصول على موعد الذي يتم وضع كل العراقيل لمنعه، وفي النهاية، غالبا ما يكون الرفض هو القاعدة. ناهيك عن أن الإجراءات مكلفة للغاية، ولا تسترجع المصاريف في حالة الرفض.
لهذه الأسباب فإننا، كجمعيات ومنظمات المغاربية في الضفتين وجمعيات مواطنية اوروبية وفرنسية، لا يمكننا قبول مثل هذا الإملاء والظلم الصارخ. ونطالب السلطات الفرنسية والبلدان الأوروبية عموما بإعادة النظر في هذه التدابير التمييزية – نحن جمعيات المهاجرين وجمعيات التضامن، التي ناضلت دائما ضد نظام التأشيرات، ونشهد اليوم تراجعا آخر يفرض تدابير تمييزية لا تحتمل.
كما ندعو جميع القوى الديمقراطية والمجتمع المدني في فرنسا وأوروبا والبلدان المغاربية إلى التعبئة، تنديدا بهذه السياسة الظالمة.

International law establishes the right to mobility by declaring the right of anyone to leave any country, including their own, and to return to it.

It also protects anyone who is migrating, regardless of their status, against any form of ill-treatment and violation of their rights, including in case of return to “a third country” (non-refoulement principle).

Does the EU's migration policy meet with these obligations? Is it in line with the current issues regarding international migration?

We propose to deconstruct these received ideas by answering “yes” or “no” to ten statements.

This is the third update of this leaflet (May, 2017) that allows a better understanding, in some pages, of the dangers of the Frontex agency and the European migration policies, which it embodies.
